Terms of Service

These Terms of Service (“Terms”) govern your access to and use of PlanGains (the “Platform”). By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. Who we are

PlanGains is a technology platform that connects subscribers with independent fitness creators (“Creators”) who provide training programs, community, and coaching-style messaging. PlanGains is not a gym, medical provider, or coach. Creators are independent third parties, not employees or agents of PlanGains, and are solely responsible for the programs, content, and messages they provide.

2. Eligibility

You must be at least 18 years old to use the Platform. By using it, you represent that you meet this requirement and that the information you provide is accurate.

3. Your account

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly of any unauthorized use.

4. Subscriptions, payments, and refunds

• Creators set their own subscription prices. Subscriptions bill monthly through our payment processor (Stripe) until cancelled.
• PlanGains charges a platform fee on Creator earnings. Card-processing and related payment costs may be borne by the Creator and deducted from their earnings.
• You can cancel anytime; access continues until the end of the paid period. Cancellation stops future billing.
• Refund requests are handled by the Creator you subscribed to, except where required by law. [Refund and dispute terms pending legal review — O2.]

5. The role of Creators

Programs, advice, community posts, and messages come from independent Creators. PlanGains does not author, endorse, or verify the accuracy, safety, or medical soundness of Creator content. Your relationship for coaching is with the Creator, not PlanGains.

6. AI-assisted messaging

Some messages you receive may be drafted with the help of artificial intelligence and reviewed by the Creator before being sent. AI-assisted replies are written in the Creator’s voice and are not medical advice. See our AI & Health-Data Disclosure for how this works.

7. Health, safety, and assumption of risk

Fitness activities carry inherent risks. Content on the Platform is for general informational and educational purposes and is not medical advice. Consult a qualified healthcare professional before beginning any exercise or nutrition program, especially if you have an injury or medical condition. You assume all risk arising from your use of programs and advice obtained through the Platform. In a medical emergency, call your local emergency number.

8. Acceptable use

You agree not to misuse the Platform, including: harassing Creators or other users, uploading unlawful or infringing content, attempting to access data you are not authorized to access, or interfering with the Platform’s operation.

9. Intellectual property

Creator programs and content remain the property of the respective Creators. PlanGains and its branding remain the property of PlanGains. You receive a limited, personal, non-transferable license to access content you subscribe to, for your own use only.

10. Disclaimers and limitation of liability

The Platform is provided “as is” without warranties of any kind. To the maximum extent permitted by law, PlanGains is not liable for indirect, incidental, or consequential damages, or for the acts, omissions, advice, or content of Creators. 11. Indemnification

You agree to indemnify PlanGains against claims arising from your misuse of the Platform or your violation of these Terms. [Pending legal review — O2.]

12. Termination

We may suspend or terminate access for violations of these Terms. You may stop using the Platform at any time.

13. Governing law

14. Changes to these Terms

We may update these Terms. Material changes will be communicated, and continued use after an update means you accept the revised Terms.
